1. Partes del acuerdo
Estos Términos y Condiciones ("Acuerdo") regulan el acceso y uso del software de trading algorítmico KENJI Bot y los servicios asociados (colectivamente, el "Software") proporcionados por KENJI Technologies Group LLC ("KENJI", "nosotros"), y usted como usuario ("Cliente" o "usted").
Al adquirir una licencia o usar el Software, usted acepta quedar vinculado por este Acuerdo. Si no acepta estos términos, no está autorizado a usar el Software.
2. Licencia de uso
2.1 Concesión de licencia
Sujeto al pago de la tarifa aplicable y al cumplimiento de este Acuerdo, KENJI le otorga una licencia personal, no exclusiva, no transferible e intransferible para instalar y usar el Software en el número de dispositivos especificado en su plan de licencia.
2.2 Restricciones
Usted NO puede:
- Copiar, modificar, distribuir, vender o sublicenciar el Software a terceros
- Realizar ingeniería inversa, descompilar o desensamblar el Software
- Eliminar o alterar avisos de derechos de autor o propiedad intelectual
- Compartir su clave de licencia con otras personas
- Usar el Software para actividades ilegales o que violen regulaciones financieras aplicables
2.3 Activación y validación
El Software requiere una clave de licencia válida para funcionar. La validación se realiza a través de LicenseSeat. KENJI se reserva el derecho de revocar licencias en caso de incumplimiento de este Acuerdo sin derecho a reembolso.
3. Precios y pagos
Los precios de las licencias se muestran en el sitio web y están expresados en dólares estadounidenses (USD). El pago se procesa a través de Stripe. KENJI se reserva el derecho de modificar los precios con previo aviso.
4. Política de reembolsos
Dado que el Software es un producto digital que se entrega inmediatamente tras el pago y cuyo uso principal comienza con la activación de la licencia,
no ofrecemos reembolsos salvo en los siguientes casos excepcionales:
- El Software no funciona tal como se describe y KENJI no puede resolver el problema técnico en un plazo razonable
- Se realizaron cargos duplicados por error técnico
- Clientes en la UE pueden ejercer el derecho de desistimiento de 14 días si no han activado la licencia (ver sección 11)
5. Propiedad intelectual
El Software, incluyendo su código fuente, algoritmos, interfaces, diseños, documentación y todos los elementos asociados, son propiedad exclusiva de KENJI Technologies Group LLC y están protegidos por las leyes de propiedad intelectual de los Estados Unidos y tratados internacionales.
Este Acuerdo no transfiere ningún derecho de propiedad sobre el Software. Usted solo adquiere un derecho de uso limitado según los términos aquí descritos.
6. Exención de responsabilidad — Riesgo financiero
IMPORTANTE — Lea atentamente:
- El Software es una herramienta de automatización de estrategias de trading. No constituye asesoramiento financiero, de inversión ni de ningún otro tipo regulado.
- El trading en mercados financieros (Forex, futuros, criptomonedas, CFDs, etc.) conlleva un alto riesgo de pérdida de la totalidad del capital invertido.
- Los resultados históricos o de backtesting mostrados no garantizan rentabilidad futura.
- KENJI Technologies Group LLC no es responsable de pérdidas financieras derivadas del uso del Software.
- Consulte a un asesor financiero regulado antes de operar con dinero real.
7. Limitación de responsabilidad
En la máxima medida permitida por la ley aplicable, KENJI no será responsable de:
- Pérdidas o daños financieros directos, indirectos, incidentales o consecuentes
- Pérdida de beneficios, datos o negocio
- Interrupciones del servicio causadas por terceros (brokers, proveedores de datos, plataformas)
- Errores o fallos del Software que no sean atribuibles a negligencia grave de KENJI
En ningún caso la responsabilidad total de KENJI excederá el monto pagado por usted por la licencia en los 12 meses previos al evento que originó la reclamación.
8. Garantías
El Software se proporciona "tal cual" ("as is") sin garantías de ningún tipo, expresas o implícitas, incluyendo pero no limitado a garantías de comerciabilidad, adecuación para un propósito particular, o no infracción.
KENJI no garantiza que el Software sea libre de errores, que funcione ininterrumpidamente, o que los resultados obtenidos sean rentables.
9. Actualizaciones y soporte
KENJI puede proporcionar actualizaciones, mejoras o correcciones de errores para el Software a su discreción. El soporte técnico se brinda a través de los canales oficiales indicados en el sitio web. KENJI se reserva el derecho de modificar, suspender o discontinuar el Software con previo aviso razonable.
10. Cumplimiento regulatorio
El Cliente es exclusivamente responsable de cumplir con todas las leyes y regulaciones aplicables en su jurisdicción relativas al uso de software de trading automatizado, incluyendo pero no limitado a requisitos de brokers, autoridades financieras y normativa fiscal sobre ganancias de capital.
El Software no está autorizado para su uso en jurisdicciones donde dicho software esté prohibido por ley.
11. Derechos de los consumidores en la Unión Europea
Los consumidores en la Unión Europea y el Espacio Económico Europeo disponen de derechos adicionales conforme a la legislación de consumo de la UE:
- Derecho de desistimiento (14 días): Tiene derecho a retractarse de la compra en un plazo de 14 días naturales desde la fecha de adquisición, siempre que no haya activado la licencia de software. Una vez activada la licencia, se entiende que ha renunciado expresamente a este derecho de desistimiento conforme al artículo 16(m) de la Directiva 2011/83/UE.
- Resolución de disputas: Los consumidores de la UE pueden acceder a la Plataforma de Resolución de Litigios en Línea (ODR) de la Comisión Europea en: ec.europa.eu/consumers/odr
12. Ley aplicable y jurisdicción
Este Acuerdo se regirá e interpretará de conformidad con las leyes del Estado de Florida, Estados Unidos, sin referencia a sus normas de conflicto de leyes.
Para usuarios en la Unión Europea, esta elección de ley no priva al consumidor de la protección que le brindan las disposiciones imperativas de la ley del país de su residencia habitual.
Cualquier disputa que no pueda resolverse amigablemente se someterá a la jurisdicción exclusiva de los tribunales competentes del Estado de Florida, USA, salvo que la ley aplicable en la residencia del consumidor de la UE disponga otra cosa.
13. Terminación
KENJI puede rescindir este Acuerdo y su licencia inmediatamente si usted incumple cualquiera de sus términos. Tras la terminación, debe dejar de usar el Software y destruir todas las copias en su posesión. Las disposiciones de este Acuerdo que por su naturaleza deban sobrevivir a la terminación continuarán vigentes.
14. Modificaciones al acuerdo
KENJI se reserva el derecho de modificar estos Términos y Condiciones en cualquier momento. Le notificaremos los cambios materiales por correo electrónico o mediante aviso en el sitio web. El uso continuado del Software tras la notificación constituye su aceptación de los nuevos términos.

1. Parties to the agreement
These Terms and Conditions ("Agreement") govern the access to and use of the KENJI Bot algorithmic trading software and associated services (collectively, the "Software") provided by KENJI Technologies Group LLC ("KENJI", "we"), and you as the user ("Client" or "you").
By purchasing a license or using the Software, you agree to be bound by this Agreement. If you do not accept these terms, you are not authorized to use the Software.
2. License grant
2.1 Grant of license
Subject to payment of the applicable fee and compliance with this Agreement, KENJI grants you a personal, non-exclusive, non-transferable license to install and use the Software on the number of devices specified in your license plan.
2.2 Restrictions
You MAY NOT:
- Copy, modify, distribute, sell or sublicense the Software to third parties
- Reverse engineer, decompile or disassemble the Software
- Remove or alter copyright or intellectual property notices
- Share your license key with other persons
- Use the Software for illegal activities or in violation of applicable financial regulations
2.3 Activation and validation
The Software requires a valid license key to operate. Validation is performed through LicenseSeat. KENJI reserves the right to revoke licenses in case of breach of this Agreement without right to refund.
3. Prices and payments
License prices are shown on the website and are expressed in US dollars (USD). Payment is processed through Stripe. KENJI reserves the right to modify prices with prior notice.
4. Refund policy
Since the Software is a digital product delivered immediately after payment and whose primary use begins with license activation,
we do not offer refunds except in the following exceptional cases:
- The Software does not work as described and KENJI cannot resolve the technical issue within a reasonable timeframe
- Duplicate charges were made due to a technical error
- EU customers may exercise the 14-day right of withdrawal if they have not activated the license (see section 11)
5. Intellectual property
The Software, including its source code, algorithms, interfaces, designs, documentation and all associated elements, are the exclusive property of KENJI Technologies Group LLC and are protected by the intellectual property laws of the United States and international treaties.
This Agreement does not transfer any ownership rights to the Software. You only acquire a limited right of use under the terms described herein.
6. Disclaimer — Financial risk
IMPORTANT — Read carefully:
- The Software is a trading strategy automation tool. It does not constitute financial, investment or any other type of regulated advice.
- Trading in financial markets (Forex, futures, cryptocurrencies, CFDs, etc.) carries a high risk of losing the entire invested capital.
- Historical or backtesting results shown do not guarantee future profitability.
- KENJI Technologies Group LLC is not responsible for financial losses arising from the use of the Software.
- Consult a regulated financial advisor before trading with real money.
7. Limitation of liability
To the maximum extent permitted by applicable law, KENJI shall not be liable for:
- Direct, indirect, incidental or consequential financial losses or damages
- Loss of profits, data or business
- Service interruptions caused by third parties (brokers, data providers, platforms)
- Software errors or failures not attributable to KENJI's gross negligence
In no event shall KENJI's total liability exceed the amount paid by you for the license in the 12 months prior to the event giving rise to the claim.
8. Warranties
The Software is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
KENJI does not warrant that the Software will be error-free, operate uninterrupted, or that the results obtained will be profitable.
9. Updates and support
KENJI may provide updates, improvements or bug fixes for the Software at its discretion. Technical support is provided through the official channels indicated on the website. KENJI reserves the right to modify, suspend or discontinue the Software with reasonable prior notice.
10. Regulatory compliance
The Client is solely responsible for complying with all applicable laws and regulations in their jurisdiction relating to the use of automated trading software, including but not limited to broker requirements, financial authorities and tax regulations on capital gains.
The Software is not authorized for use in jurisdictions where such software is prohibited by law.
11. EU consumer rights
Consumers in the European Union and the European Economic Area have additional rights under EU consumer legislation:
- Right of withdrawal (14 days): You have the right to withdraw from the purchase within 14 calendar days from the date of acquisition, provided you have not activated the software license. Once the license is activated, you are understood to have expressly waived this right of withdrawal pursuant to Article 16(m) of Directive 2011/83/EU.
- Dispute resolution: EU consumers can access the European Commission's Online Dispute Resolution (ODR) Platform at: ec.europa.eu/consumers/odr
12. Governing law and jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without reference to its conflict of law provisions.
For users in the European Union, this choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of the State of Florida, USA, unless applicable law in the EU consumer's residence provides otherwise.
13. Termination
KENJI may immediately terminate this Agreement and your license if you breach any of its terms. Upon termination, you must cease using the Software and destroy all copies in your possession. Provisions of this Agreement that by their nature should survive termination will remain in effect.
14. Modifications to the agreement
KENJI reserves the right to modify these Terms and Conditions at any time. We will notify you of material changes by email or by notice on the website. Continued use of the Software after notification constitutes your acceptance of the new terms.
